Absentee Bids Terms

Please read our terms carefully. Your Absentee or
Phone Bid is Binding.
As a convenience for our clients who are unable to
attend one of our auctions,
we accept absentee bids.
If you are unable to attend an auction in
person and wish to place one or more bids, you may use our online form or fax
form to give Landry Auctions
instructions to bid on your behalf. We also accept phone bids. Please call
us at (978)768-6233.
A Credit Card is required to secure
Absentee Bids and Phone Bids.
After placing an Absentee or Phone Bid, our representatives will then
attempt to purchase the lot(s) of your choice for the lowest price
possible, not to exceed the maximum amount(s) you indicate. This
service is free and confidential.
Please note: While we will
make every effort to purchase lots on your behalf, Landry Auctions will
not be responsible for any errors or failure to execute any bids.
Be sure to accurately list your lot descriptions and lot numbers, if
applicable.
You should be equally clear about the maximum bid you are willing to pay
for each lot. Unlimited bids or "Just
buy" will not be accepted.
A
buyer's premium of 15% will be
added to the hammer price. Massachusetts State Tax of
6.25% will also be added. Please submit your Tax Resale Number if
applicable.
We recommend that you place your bids as early as possible.
In the event of identical absentee bids, the earliest absentee bid
received will take precedence.
All absentee bids via Fax, Online, or Phone must be received no
later than 3:00 on the day of the sale.
In the event of an identical bid on the
floor, the bid in attendance shall take precedence. If you choose the
"Plus One Bid" option on the online form, this will authorize our Representative to bid one
increment higher if the bid on the floor matches your maximum bid.
After the auction, successful bidders will be notified of amount
payable, including the buyer's premium and applicable tax.
Each bid is per lot and all bids will be
executed and accepted subject to the following Terms and Bidder
Agreement.

Terms of Payment and Bidder
Agreement
Identification:
All purchasers are required to give full names, addresses, and
telephone numbers.
Landry Auctions will accept Visa and/or MasterCard for
absentee bids. Placing an absentee bid with Landry Auctions constitutes
the bidder's agreement to have Landry Auctions charge all purchases,
applicable premiums, and taxes to the absentee bidder's credit card and
said charge may not be reversed. The absentee bidder's
name and the name on the credit card, must be one and the same.
The Auctioneer acts as an agent only. Every item
and/or lot is sold “as is and where is” with all faults and errors of
description and the Auctioneers disclaim all responsibility for
authenticity, age, provenance, origin, condition or quality. All
statements on such matters, whether printed or made orally, are
statements of opinion and not representations of fact. Purchasers are
deemed to have satisfied themselves on authenticity, age, provenance,
origin, condition, and quality before the sale, and no one in the Auctioneer's
employment has authority to make any representation of fact.
All merchandise must be paid for in full prior to the
removal of any items. Landry Auctions will not be responsible for any
merchandise left on the premises longer than fifteen (15) days after the
auction date, even if said merchandise has been paid for in full. Landry
Auctions reserves the right to resell the merchandise, and any monies
paid by the previous buyer will be retained by Landry Auctions as
compensation.
Landry Auctions will represent items to the best of our ability but is
not responsible for errors, withdrawn lots, or omissions. Prospective
bidders are encouraged to preview lots of interest in person or send a
representative to inspect lots.
